Under Section 19-152 of New York’s Administrative Code, property owners are responsible for installing, repairing and maintaining sidewalks adjoining their properties. DOT staff inspect sidewalks and notify property owners of needed repairs. In the event timely repairs are not made by the property owner, the City may hire private construction firms to make the repairs.
When this happens, the City bills the property owner for the costs of the repairs. Property owners must also keep their sidewalks clean and are responsible for snow removal. DOT inspects sidewalks throughout the city to ensure that they are safe. If inspectors find an unsafe sidewalk defect, they issue a notice of violation. Violations are issued in every neighborhood in the city.
Sidewalk Violations are also called Sidewalk Liens. The city will attach them to your property like a lien and they will also appear up on title searches. When someone is looking to refinance or sell the property these violations may cause issues with closing, it’s best to take care of them before they become an issue. Also, if someone trips and falls on the broken sidewalk, it’s possible that you could be liable.
